These Terms & Conditions ("Terms") govern your use of histakesai.com (the "Site") and the services provided by HighStakes AI ("HighStakes AI," "we," "us," or "our"), a business of High Stakes Automations based in Pensacola, Florida. By accessing the Site, contacting us, or using our services, you agree to these Terms. If you do not agree, please do not use the Site or services.

01Our Services

HighStakes AI provides marketing and web services for local businesses, including custom website design, local search engine optimization (SEO), and advertising and social media management. Specific deliverables, timelines, and fees for paid engagements are set out in a separate proposal or agreement between you and HighStakes AI. Information on the Site is for general purposes and does not guarantee any specific result.

02SMS / Text Messaging Program Terms

The following terms apply to our SMS/text messaging program. By providing your mobile number and opting in (for example, by checking the consent box on our forms), you agree to these terms:

1. Program name & description. The HighStakes AI messaging program sends non-marketing messages (appointment and meeting reminders, account and project updates, requests for job photos, and customer care) to our clients and to people who contacted us and opted in. It does not send promotional messages.
2. How to opt out. You can cancel the SMS service at any time by texting STOP to the number from which you received messages. After you send STOP, we will send a one-time confirmation and will stop sending messages. You may receive additional messages confirming your opt-out.
3. How to rejoin. If you opt out and later wish to resume messages, simply opt in again by texting START or by submitting a form on our Site.
4. Help. For help, text HELP to the number from which you received messages, email ben@histakesai.com, or call (850) 943-2040.
5. Carrier liability. Carriers are not liable for delayed or undelivered messages.
6. Message & data rates. Message and data rates may apply for any messages sent to you from us and to us from you. Contact your wireless provider for details on your plan.
7. Message frequency. Message frequency varies based on your interaction with us and the services you request.
8. Privacy. Your information is handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
9. Compliance. Our messaging program adheres to applicable industry standards and laws, including CTIA guidelines and the Telephone Consumer Protection Act (TCPA). Consent to receive messages is not a condition of any purchase.

03Acceptable Use

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, its servers, or related systems.
• Interfere with or disrupt the Site, or introduce malware or harmful code.
• Copy, scrape, or reproduce Site content without our written permission.

04Intellectual Property

All content on the Site — including text, graphics, logos, designs, and the HighStakes AI name and brand — is owned by or licensed to HighStakes AI and protected by intellectual-property laws. You may not use it without our prior written consent. Work products delivered under a paid engagement are governed by the applicable client agreement.

05Third-Party Services & Links

The Site and our services may rely on or link to third-party platforms (such as hosting, analytics, advertising, and messaging providers). We are not responsible for the content, policies, or practices of third parties.

06Disclaimers

The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Marketing, SEO, and advertising results vary and are not guaranteed.

07Limitation of Liability

To the fullest extent permitted by law, HighStakes AI and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or services. Our total liability for any claim relating to the Site will not exceed the amount you paid us, if any, for the service giving rise to the claim.

08Indemnification

You agree to indemnify and hold harmless HighStakes AI and its owner from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

09Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Florida.

10Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest version. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
